Agreement to Terms

By accessing and using the Authentic Beauty by Monica website (authenticbeautymonica.com) and services, you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Services

Authentic Beauty by Monica provides professional makeup artistry and beauty services, including:

• Bridal makeup and hair styling

• Special event makeup services

• Private makeup lessons and consultations

• Beauty bestie sessions and tutorials

• On-set makeup for film, TV, and editorial projects

• Group makeup services for weddings and events

User Accounts and Bookings

Account Creation

• You may need to create an account to access certain services

• You are responsible for maintaining the confidentiality of your account information

• You agree to provide accurate, current, and complete information

Service Bookings

• All appointments must be booked through our official booking system or direct consultation

• Payment or deposit is required to secure your booking

• Cancellation and rescheduling policies apply as outlined below

Payment Terms

Pricing

• All prices are listed in USD unless otherwise specified

• Prices are subject to change without notice

• Payment schedules vary by service package:

  • Trials: Full payment due at time of booking

  • Wedding Services: 50% deposit required to secure date, balance due 48 hours before event

  • Other Services: Payment due at time of booking or as agreed upon

Payment Methods

• We accept major credit cards, cash, and digital payment methods as displayed

• All electronic payments are processed securely through third-party payment processors

• Gratuity is appreciated but not required

Travel Fees

• Services within 30-mile radius of Bay Area base location included in package pricing

• Additional travel fees apply for locations beyond 30-mile radius

• Destination wedding travel costs (flights, accommodation) are the client's responsibility

Cancellation and Rescheduling Policy

Client Cancellations

• 7+ days notice: Full refund minus 15% processing fee, or free rescheduling

• 48-72 hours notice: 50% refund, rescheduling subject to availability

• Less than 48 hours notice: 25% refund, no rescheduling

• No-show: No refund or rescheduling

• Wedding cancellations: Deposits are non-refundable within 30 days of event

Provider Cancellations

• If we need to cancel due to illness or emergency, you will receive a full refund or priority rescheduling

• We will make every effort to provide a qualified substitute artist when possible

Weather and Force Majeure

• Outdoor events affected by severe weather may be rescheduled without penalty

• Force majeure events (natural disasters, government restrictions) allow for full rescheduling or refund

Intellectual Property Rights

Our Content

• All content on our website, including text, graphics, logos, photos, and video materials, is owned by Authentic Beauty by Monica

• You may not reproduce, distribute, or create derivative works without written permission

Client Photos and Images

• You retain ownership of photos taken of you during our services

• By booking our services, you grant us permission to take photos for our records and quality assurance

• Separate written consent is required for use of your photos in marketing materials

• You may request removal of your images from our portfolio at any time

Portfolio Usage

• We may photograph our work for portfolio and social media purposes

• Client consent will be obtained before sharing any identifiable images

• We respect your privacy and will honor any requests for image removal

User Conduct

You agree not to:

• Use our services for any unlawful purpose

• Harass, abuse, or harm our staff or other clients

• Submit false or misleading information about allergies, skin conditions, or preferences

• Arrive to appointments under the influence of drugs or alcohol

• Bring unauthorized guests to private sessions without prior approval

• Violate any applicable laws or regulations

Health and Safety

Allergies and Skin Sensitivities

• You must disclose all known allergies and skin sensitivities before service

• We are not liable for reactions to products when allergies are not disclosed

• A patch test may be recommended for clients with sensitive skin

Hygiene Standards

• We maintain the highest standards of cleanliness and sanitation

• All brushes and tools are cleaned and sanitized between clients

• Single-use applicators are used when appropriate

Health Conditions

• Clients with active skin infections, cold sores, or contagious conditions may need to reschedule

• We reserve the right to refuse service if health and safety concerns exist

Service Disclaimers

Makeup Longevity

• While we use professional, long-wearing products, makeup longevity depends on individual skin type, weather, and activities

• Touch-up kits are provided to maintain your look throughout your event

Photography Results

• Makeup may appear different in various lighting conditions and cameras

• We recommend discussing photography plans during consultation for optimal results

Skin Reactions

• Despite patch testing and professional products, individual skin reactions can occur

• We are not liable for unexpected skin reactions when proper disclosure protocols are followed

Limitation of Liability

To the fullest extent permitted by law:

• Authentic Beauty by Monica shall not be liable for any indirect, incidental, or consequential damages

• Our total liability is limited to the amount paid for services

• We are not responsible for events outside our control that affect your scheduled services

• We are not liable for decisions made by photographers, venues, or other vendors

Indemnification

You agree to indemnify and hold harmless Authentic Beauty by Monica from any claims, damages, or expenses arising from your use of our services, failure to disclose relevant health information, or violation of these Terms.

Termination

We reserve the right to:

• Terminate or refuse service to clients who violate these terms

• Cancel appointments due to health and safety concerns

• Modify or discontinue services at any time with appropriate notice

Professional Conduct

Boundaries

• Our relationship is professional and service-based

• We maintain appropriate boundaries during all interactions

• Any inappropriate behavior will result in immediate service termination

Referrals

• We may refer clients to other professionals when services fall outside our expertise

• We do not provide medical advice or treat skin conditions requiring medical attention

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California.

Dispute Resolution Process

• Initial disputes should be addressed through direct communication

• We are committed to resolving any service concerns promptly and professionally

• If unresolved, disputes will be settled through binding arbitration in California

• You waive the right to participate in class action lawsuits

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, technical failures, government actions, or public health emergencies.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified Terms. Significant changes will be communicated via email to active clients.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Authentic Beauty by Monica regarding the use of our services.
